These terms and conditions of sale are applied to all sales of products marketed by Donnachiara through the website www.donnachiara.com
Therefore all purchase contracts through donnachiara.com will be based on these General Conditions.
1. Changes to the terms and conditions
This agreement may be changed at any time and any change will be effective immediately after its publication on the website www.donnachiara.com, therefore the Customer needs to check this agreement at every access to the site and to comply with subsequent modifications.
2.Acceptance of sales conditions
The contract between the Customer and Donnachiara (owner of the site www.donnachiara.com) is concluded with the acceptance, even if only partial, and at its sole discretion, of the order. Acceptance is considered tacit, unless otherwise communicated in any manner to the Customer. In case of non-acceptance of the order, www.donnachiara.com com its itself to a timely communication with the Customer.
By placing an order, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general and payment conditions transcribed below.
The Customer is not entitled to any compensation for damages, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and / or property caused by the non-acceptance, even partial, of an order.
3. Purchase mode
The sale of alcoholic products is forbidden to minors under the age of 18.
The Customer who is older than 18 can purchase the products in the electronic catalogue of www.donnachiara.com
Once the order is placed, an email confirmation will be sent to the email address provided by the Customer. The email confirmation will include an “Order Number” to be used in any further communication with www.donnachiara.com. The email contains all the data entered by the Customer, who needs to verify that they are correct and promptly communicate any corrections according to the procedures described in this document.
All prices on this site are inclusive of VAT, unless otherwise indicated. www.donnachiara.com has the right to change prices at any time without notice.
4. Payment methods
a) ADVANCE PAYMENT VIA BANK TRANSFER
In the case of Advance Payment via Bank Transfer, the order will be sent only when the money is credited to the company Donnachiara (owner of the site www.donnachiara.com) within 5 working days from the date of purchase, after which the order is automatically canceled. The reason for the bank transfer must contain the order number issued in the email confirmation. The bank details are sent via email when the order is accepted.
b) PAYPAL
Once the order is confirmed, the Customer will be redirected to Paypal’s website, where they can make their payment with their Paypal account or use a card, even a prepaid one, or in any case according to the methods accepted by Paypal and in compliance with these conditions. In the case of order cancellation requested by the Customer or Donnachiara, the amount paid for the cancelled goods will be credited back to the Customer’s Paypal account.
For every order placed on donnachiara.com, an invoice will be issued in accordance with Article 14 of the D.P.R. 445/2000 and DL 52/2004 and will be sent to the purchaser together with the products. The information provided by the Customer will be used to issue the invoice. Donnachiara therefore reminds the customer to always check, with the utmost care, the accuracy of the information provided. No change in the invoice will be possible after being issued.
5. Minimum quantity of products to be purchased
There is no minimum quantity of products to be purchased.
6. Shipping methods
Donnachiara (owner of the site www.donnachiara.com) sell their products in Italy.
Shipping costs are at the expense of the Customer and this is highlighted at the time of purchase.
The ordered goods are delivered approximately within five working days from 09:00 to 13:00 and from 14:00 to 18:00 every day (with the exception of holidays) from Monday to Friday. No responsibility can be attributed to Donnachiara (owner of the site www.donnachiara.com) in case of delayed delivery.
When the goods are delivered by the carrier, the customer is required to check:
that the number of packages delivered corresponds to the one indicated in the order;
that the packaging is intact, not damaged, wet or otherwise altered;
if donnachiara.com stickers seal the packages.
Any external damage or incorrect number of packages must be immediately reported to the carrier by writing “Goods unchecked” on the accompanying document, specifying the reason (e.g. damaged packaging) and sending it to info@donnachiara.it within 48 hours; any report beyond the aforesaid terms cannot be taken into consideration. In the specific case of damaged package, write “accepted provisionally because the package is damaged”. Once the carrier’s document has been signed “provisionally”, the Customer cannot make any objection to the condition of the delivered goods.
The Customer becomes responsible for every declaration made.
7. Return of goods
If for any reason the Customer is not satisfied with the products received, they are entitled to withdraw from the contract by communicating it via registered mail within 14 days after receiving the goods and by returning all the purchased goods within additional 14 days.
The company Donnachiara (owner of the site www.donnachiara.com) will reimburse the price of the returned goods with the modalities specified by the customer in the letter of withdrawal after receiving the products and verifying that they have not been damaged, broken or altered.
The return of the goods is at the expense of the customer, who is responsible for taking all the necessary precautions in order to protect the goods from any damage. Donnachiara (owner of the site www.donnachiara.com) has the right to refuse the goods if they are returned damaged or altered.
8. Limitation of liability
The company Donnachiara (owner of the site www.donnachiara.com) is not responsible for any error or omission, technical inaccuracy or misspelling on the website or web services interruption.
9. Links to third-party websites
The links on the website allow access to other sites that are not under the control of Donnachiara (owner of the site www.donnachiara.com) who is not responsible for the content on the linked sites.
10. Current legislation and competence
Any dispute relating to the application, execution, interpretation and violation of the contract that the Customer stipulated online with the company Donnachiara (owner of the site www.donnachiara.com) is subject to the Italian jurisdiction and the place of jurisdiction is the place of residence or domicile of the Customer, if located in the Italian territory, or that of execution of the contract in the case of domicile or residence abroad.
11. Illegitimacy of the terms and conditions
If for any reason a part of these terms and conditions is inapplicable, the validity of the terms and conditions of the other parts will not be affected.
